provide you with access to B.A.C.'s online marketing business
and tools and assistance to meet the needs of it's members.
Please read these Terms of Use (the "Terms") carefully
before continuing with your use of this Web Site. These Terms
shall govern the use of the Web Site and apply to all internet
traffic visiting the Web Site. By accessing or using this
Web Site, you agree to the Terms. The Terms are meant to protect
all of our Web Site visitors and your use of this Web Site
signifies your agreement with these Terms. IF YOU DO NOT AGREE
WITH THESE TERMS, DO NOT USE THIS WEB SITE. B.A.C. reserves
the right, in it's sole discretion, to modify, alter or otherwise
update these Terms at any time. Such modifications shall be
effective immediately upon posting. By using this Web Site
after we have posted notice of such modifications, alterations
or updates you agree to be bound by such revised Terms.
In accordance with our goals, this
Web Site will permit you to link to other web sites, that
may or may not be affiliated with this Web Site and/or B.A.C.
and that may have terms of use that differ from, or contain
terms in addition to, the terms specified here. Your access
to such web sites through links provided on this Web Site
is governed by the terms of use and policies of those sites,
not this Web Site. B.A.C. HAS NO LIABILITY OR RESPONSIBILITY
WITH RESPECT TO THE CONTENT, OPERATION OR TERMS OF USE OF
SUCH OTHER WEB SITES.
Privacy
Registration data and certain other
information about you is subject to our Privacy Policy. For
more information, please review our full Privacy policy.
Advertising/Promotion
As a B.A.C. member you are not permitted
to purchase leads, guaranteed signups or perform any "cold
calling" as a means of promoting B.A.C. This means no
optin, double-optin, triple-optin leads (or prospect lists)
from external sources. Solicitation by email or phone is strictly
forbidden. This is to protect B.A.C. and it's members from
receiving any SPAM complaints. Any violation of this policy
will result in the immediate termination of the membership
ceasing any income earned from B.A.C. and forfeiting any unpaid
commissions. There will be no refund entitlements.
Paid Membership Plans
Any member who selects a paid membership
plan that requires correspondence with a sponsored child or
children (a BAC Caring Parent) is deemed to have accepted
this correspondence as a requirement of the selected paid
membership plan. The definition of "required correspondence"
is governed by the rules and requirements of the charitable
organization with which the sponsorship has been established.
Any BAC Caring Parent who fails to comply with the required
correspondence to the sponsored child or children will be
downgraded to an equivalent paid membership plan that does
not require such correspondence. This downgrading is solely
at B.A.C.'s discretion and any loss of monthly income by the
member due to the downgrade is the member's responsibility.
If a membership is downgraded due to these circumstances the
member cannot apply to B.A.C. for any form of refund, compensation
or claim any loss of income. It is the member's responsibility
to comply with any paid membership plan's requirements and
any failure to do so is at the member's own risk. The maximum
number of sponsored children an individual Caring Parent can
care for at any one time is 10. If a Caring Parent can prove
they can care for more than 10 sponsored children at any one
time BAC may, in it's discretion, increase the number of allowed
children for that Caring Parent to 21. BAC reserves the right
to change this maximum number, either up or down, at any time
and without warning.
Cooling Off Period / Refund
In many countries there is a legal
requirement for a cooling off period of up to 14 days after
a customer has made a purchase. During this cooling off period,
the customer can cancel their purchase and request a full
refund of their payment. Paid memberships with BAC are subject
to this cooling off period. This means that any new member
can cancel their membership with BAC within the first 14 days
of their membership and receive a full refund.
B.A.C. Surrogate Caring Parent
Any member who selects to become a
B.A.C. Surrogate Caring Parent is deemed to have accepted
that a B.A.C. Surrogate Caring Parent is required to correspond
with sponsored children. The definition of "required
correspondence" is governed by the rules and requirements
of the charitable organization with which the sponsorship
of the children has been established. Any member who, having
selected this option, fails to comply with the required correspondence
to the sponsored children will be deemed to have breached
the requirements for this membership with B.A.C. If such a
breach occurs, B.A.C. reserves the right to terminate the
B.A.C. Surrogate Caring Parent membership. If a membership
is canceled due to these circumstances the member cannot apply
to B.A.C. for any form of refund, compensation or claim any
loss of income. It is the member's responsibility to comply
with any membership requirements and any failure to do so
is at the member's own risk. The maximum number of sponsored
children an individual Surrogate Caring Parent can care for
at any one time is 21. BAC reserves the right to change this
maximum number, either up or down, at any time and without
warning.
Charitable Organizations
Once the initial paid membership registration
process is complete and the member has initiated a sponsorship
relationship with a charitable organization, the member is
responsible for their relationship with the charitable organization.
All problems and questions regarding the sponsorship must
be directed to the charitable organization and not to B.A.C..
All B.A.C. members are required to adhere to the terms and
conditions of the charitable organizations that they are associated
with as part of their paid B.A.C. membership plans. This includes
all terms of use of the charitable organization's web site
as well as rules and regulations covering contact and the
member's relationship with any sponsored child, children or
project. Any action deemed to be in breach of these terms
by the charitable organization may affect the member's membership
status with B.A.C.. B.A.C. reserves the right to terminate
the membership of any member who has been deemed to have breached
the terms of use or regulations of the charitable organizations
that they are associated with as part of their paid B.A.C.
membership plans. If a membership is canceled due to these
circumstances, the affected member cannot apply to B.A.C.
for any form of refund, compensation or claim any loss of
income.
Trademarks, Copyrights and Restrictions
This Web Site is controlled and operated

at it's discretion for any reason, including for violation

B.A.C. and it's Providers, it's and their officers, directors,

each of these individuals or entities shall have the right
to assert and enforce these Terms directly against you on
it's or their own behalf.

Unless otherwise specified, the content

and/or information. This Web Site is controlled by B.A.C.
from it's offices within Hollywood, CA and operated by it's
host provider in Scottsdale, AZ. B.A.C. makes no representation
that content in it's Web Site is appropriate or available
for use in other locations. Those who choose to access this
Web Site from other locations and use or engage in any of
the functions or services contained herein do so on their
own initiative and are responsible for compliance with local
laws, if and to the extent local laws are applicable. You
may not use or export the materials in this Web site in violation

laws of the state of California, as they are applied to agreements

Entire Agreement
The provisions and conditions of these
Terms and each obligation referenced herein with respect to
the use of this Web Site, represent the entire agreement between
B.A.C., it's affiliated or related entities, and you and supersede
any prior agreements or understandings not incorporated herein.
In the event that any inconsistencies exist between these
Terms and any future published terms of use or understanding,
the last published Terms or terms of use or understanding
shall prevail. Any further contracts, terms, agreements, rules
and regulations of a specific nature contained on this Web
Site with respect to purchases, participation in the Pay Plans
and use of copyright and trademark materials ("Specific
Agreements") and which those Specific Agreements shall
supersede, but only to the extent they are inconsistent with
the above provisions.
